By downloading, installing, or using the NowBoarding mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our App.

These Terms apply to all users of the App, regardless of location or subscription status.

Description of Service

NowBoarding is a flight tracking application that provides real-time flight information, notifications, and related aviation services. The App is available for all ages and suitable for personal, non-commercial use.

We offer both free and premium subscription tiers with different features and limitations as described within the App.

User Accounts and Responsibilities

Account Creation

  • You may create an account to access additional features
  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account

Acceptable Use

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App's functionality
  • Share your account credentials with others
  • Use automated tools to access the App without permission
  • Submit false or misleading information
  • Spam our systems, services, or other users
  • Abuse, overload, or attempt to circumvent our APIs or rate limits
  • Make excessive requests that could harm our service performance
  • Use our services to send unsolicited communications

Subscription and Payments

Premium Subscriptions

  • Premium features are available through monthly subscriptions
  • Subscription fees are charged through the Google Play Store
  • Subscriptions automatically renew unless cancelled
  • You can cancel your subscription at any time through Google Play Store

Billing and Refunds

  • All payments are processed by Google Play Store
  • Billing terms are subject to Google Play's payment terms
  • Refund requests must be made through Google Play Store
  • Google Play's refund policy applies to all purchases
  • We offer a 7-day free trial for new Premium subscribers

Price Changes

We reserve the right to change subscription prices with advance notice. Price changes will not affect existing subscribers until their next renewal cycle.

Data Accuracy and Availability

  • Flight information is provided by third-party sources
  • We strive for accuracy but cannot guarantee real-time precision
  • Service availability may be affected by technical issues
  • Always verify critical flight information with official sources
  • We are not liable for missed flights or travel disruptions

Intellectual Property

The App and its content, features, and functionality are owned by NowBoarding and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

Privacy and Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimers and Limitation of Liability

Service Disclaimers

The App is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, NowBoarding shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to:

  • Missed flights or travel disruptions
  • Inaccurate flight information
  • Service interruptions or downtime
  • Loss of data or information

Termination

We may terminate or suspend your account and access to the App at our discretion, with or without notice, for violations of these Terms or other reasons we deem appropriate.

You may stop using the App at any time. Upon termination, your right to use the App ceases immediately.

Updates and Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or other reasonable means. Your continued use of the App after changes constitutes acceptance of the updated Terms.

We may also update the App's features, functionality, or requirements from time to time.

Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App will be resolved through appropriate legal channels.
